I think Microsoft will get a stay on at least some of Jackson's conduct remedies, but I don't think it will get a stay on all of them, ... If the company does get a stay on all of them, that is a positive signal for Microsoft on how the Appeals Court or the Supreme Court would rule on the merits of its appeal.

They have not agreed to provide written assurances they will comply with Immigration and Naturalization Service instructions if they do not prevail in the appeals court and cannot obtain a stay from the Supreme Court.

I think Microsoft will win on the tying issue at the appeals court level, but whether they will win that point at the Supreme Court is another question.

It's surprising that they took 17 pages to respond to our two-paragraph request for a stay from the trial court. These requests are normally pro-forma. The real request for a stay is filed at the appeals court level.

I would think this is a long shot, trying to get the Court of Appeals to stop this trial. The defense has a better chance of having a stay granted than winning on the merits of the claim.

The government's petition is certainly questionable about the rationale for expediting this case directly to the Supreme Court. Microsoft does not believe that the government should try to evade the Court of Appeals.

The judge knows that Microsoft will appeal, and the tougher the penalties imposed on Microsoft by the judge, the more likely it is that the appeals court will modify them.

Microsoft doesn't respect the antitrust laws, and it has amply demonstrated that it can't be trusted. The company has shown its contempt for any court-imposed changes in its conduct. If the government ends the antitrust case by seeking changes in its conduct, but not in its structure, Microsoft can be expected to creatively evade the thrust of such agreements.

The government will argue that staying the conduct remedies pending appeal will have further anti-competitive effects. The burden then would be on Microsoft to show that those remedies would have such a dramatic effect on their business that it would be inequitable to have them go into effect before the appeal. The outcome of the two arguments depends on art as well as science.

The appeals court may say it is only talking about Windows 95 in its interpretation of the consent decree, ... It does have an influence. The Court of Appeals will inevitably say something about the appropriateness of Microsoft's behavior.

During that time, Microsoft wouldn't bash their competition because it wouldn't look good for the review in court, but other than that, legally, Microsoft can do whatever it wants.

It's not without basis to say that the Court of Appeals is the preferred place for Microsoft, ... But normally on fact finding, appeals judges give great deference to a lower court.

We also believe such controversy, if any, would come at a poor time for Microsoft, given that the company is awaiting the Appeals Court ruling on the existing antitrust trial. As a result, we believe it is possible that this could put a damper on the positive sentiment surrounding the stock.
