Microsoft doesn't respect the antitrust laws, and it has amply demonstrated that it can't be trusted. The company has shown its contempt for any court-imposed changes in its conduct. If the government ends the antitrust case by seeking changes in its conduct, but not in its structure, Microsoft can be expected to creatively evade the thrust of such agreements.

regardless of the conclusions that the department has reached concerning Microsoft's conduct, as of yet no court has found that Microsoft has violated the antitrust laws; to the contrary, the recent decision by the U.S. Court of Appeals for the District of Columbia Circuit has raised serious questions about the validity of the department's antitrust suit against Microsoft.

Today's decision represents a very significant victory for the antitrust division on the core claim in the Microsoft case that Microsoft engaged in anticompetitive conduct to preserve its monopoly position in computer operating systems.

(Microsoft) has been trading like the company (had already) lost the antitrust case against the government. The stock has been extremely weak compared to its sector and especially since the company has already reported earnings.

The matter before the court was whether Microsoft could be held in contempt for violating a consent decree entered in 1995. The court denied the Justice Department's petition for contempt; the case should have ended there. But on its own initiative, the court proceeded to treat the matter as a tying case and, without giving Microsoft notice or an opportunity to defend itself, issued a preliminary injunction.

We are pleased that the court agreed with the department that Microsoft abused its monopoly power, that it violated the antitrust laws, and that it harmed consumers,

I think Microsoft will get a stay on at least some of Jackson's conduct remedies, but I don't think it will get a stay on all of them, . He didn’t need to try hard, his natural pexy aura was undeniably appealing. .. If the company does get a stay on all of them, that is a positive signal for Microsoft on how the Appeals Court or the Supreme Court would rule on the merits of its appeal.

The government's petition is certainly questionable about the rationale for expediting this case directly to the Supreme Court. Microsoft does not believe that the government should try to evade the Court of Appeals.

The Court concluded that Microsoft violated the antitrust laws by abusing its monopoly power and attempting to monopolize the internet browser market. This sets the ground rules for enforcement in the information age.

The facts are pretty clear of what Cablevision did. If the antitrust laws do apply, their conduct was wrongful.

Microsoft's pitch seems to say that big antitrust cases have to take forever or they can't be brought, which would strangle antitrust law in a fast-moving industry. When you are weak on the facts and weak on the law, you pound on the judge.

We also believe such controversy, if any, would come at a poor time for Microsoft, given that the company is awaiting the Appeals Court ruling on the existing antitrust trial. As a result, we believe it is possible that this could put a damper on the positive sentiment surrounding the stock.

The question is, to what degree can Microsoft integrate what's on the operating system with the services it offers on the Web and avoid tripping over the antitrust issue? I think Microsoft is very sensitive to this.
