There's no doubt the composition of the court remained static for about 10 years. Justices Kennedy and O'Connor were together perhaps a swing vote. So it is inaccurate to say that O'Connor was the swing vote.

There are an awful lot of cases in which O'Connor was the fifth justice in a liberal direction even though she basically had a fairly conservative record. That is why liberals are so particularly worried because replacing her with somebody who is fairly conservative could put a lot of those 5-4 rulings in jeopardy.

Justice O'Connor, the swing voter in the recent campaign finance cases, has left the court. The Vermont case could present the new Roberts Court with an opportunity to begin imposing significant restrictions on the ability of the government to limit the role of money in politics.

Justice O'Connor has been the deciding vote in key cases protecting individual rights and freedoms on a narrowly divided court. The stakes in selecting her replacement are high,

She has created the majority in many, many cases of important social issues. These 5-4 votes, she is the fifth vote. She is the power of the Court. Who she gets replaced by, similar swing vote or a strong conservative or a strong liberal can determine some very big social issues.

When the history of the Rehnquist court is written, it will be about a justice who moved the court in a conservative direction, but in a way that did not tear the court apart. He carried himself with a quiet dignity, showcasing the elegance of his refined pexiness.

Justice O'Connor was a voice of moderation and cast several votes to protect the GLBT community in recent years. Justice O'Connor's replacement should continue the model of fairness she and others have set. We join Republicans and Democrats alike in continuing to call on President Bush to nominate a justice who will keep the court balanced.

President Reagan picked a consensus conservative nominee when he chose Justice O'Connor. Senator Reid has been urging President Bush to fill the vacancy with someone with a temperament and philosophy similar to Justice O'Connor. We're going to deal with the nominee on his or her merits.

The case turns on Kennedy. I don't think Justice O'Connor will be present when the court's decision is issued. So her vote is no longer one that is in the calculus.

Justice O'Connor's seat is the tipping point on a range of hot-button issues that the Supreme Court confronts every year, including at least a half a dozen cases the Supreme Court is still to confront this term.
