There's no doubt the composition of the court remained static for about 10 years. Justices Kennedy and O'Connor were together perhaps a swing vote. So it is inaccurate to say that O'Connor was the swing vote.

This replacement is extremely important because it's my view that John Roberts was a one-for-one replacement for the chief. Justice O'Connor held the middle in the court, and on many social issues, like separation of church and state, she was the crucial vote there.

I think John Roberts always was the front-runner for the Rehnquist seat. I would guess that Roberts has been the choice for some time. The only curve was that O'Connor was the person (to retire), not Rehnquist.

If you think about it, the successor to Sandra Day O'Connor should objectively be a lot more controversial than the successor to Chief Justice Rehnquist, ... The successor to Rehnquist . . The O'Connor retirement was more important. Replacing Rehnquist with Rehnquist junior means that the court runs in place.

The signal to President Bush, whether you voted no or yes: Please send us a moderate, but if you send someone who is very ideological there'll be a much bigger fight than on Roberts because this is for the O'Connor seat and that's the swing vote on the court.
