en I think there's a growing realization or acknowledgment in the Legislature that we simply can't afford to get tougher and tougher on penalties every session. Enhancing penalties may have been politically popular in the past, but we simply don't have the money or the (prison) space now to do it.

en After the hearings on the House side in March and after receiving the commissioner's letter (re tougher penalties), we had discussions both before and after. There was an agreement that it would be unfair to change the deal in the middle of the season. I then sent the tapes of the (March) hearings to the players. I had an obligation to meet with them all, which I did.

en They could, I suppose, put in some mandatory penalties that would up the ante. But increasing penalties does not necessarily increase prosecutions. It may make them harder -- tougher penalties could make judges more cautious and raise more grounds for appeal.

en The best news in this year's report is the significant decline in cigarette smoking, not just because that ultimately is the most deadly drug but also because it confirms that drug abuse is best reduced through sensible public health measures rather than criminal penalties, prosecutions and prisons.
