I don't see it as a threat at all to Apple's music empire.

It represents a big win for Apple and the Mac platform. But Apple doesn't represent a threat to AOL's business. Apple isn't a media company; it's not in online services. It's not the same threat as when Microsoft wanted interoperability.

Consumers don't really want to carry around more devices than they have to. Everyone has a mobile phone. To get music onto the phone is a big deal for the music industry. Why does Apple care? Apple Computer can go into the recorded music business in any way they want. What they cannot do is use the Apple (trade)mark to do it.

How seamless does that mechanism need to be under this law? The devil here is in the detail. It's quite possible that Apple says they're in compliance with this law. No one is locked into Apple's music format.

The facts show that there was a broad negotiation between Microsoft and Apple. The facts show that Apple had put a $1.2 billion patent threat on the table against Microsoft. . . . If anyone was wielding a club in these negotiations, it was Apple, not Microsoft.

It seems to me very difficult to implement this legislation at a European-wide level because it would take too big of a bite into Apple's business. Right now, Apple's is the leading model in terms of digital music.
