The appeal process is a waste of time. Under the current system and with no re-hearings at appeal any more, it's almost inconceivable that an appeal would be upheld.

We have been waiting anxiously to file our appeal, but we have to wait until the judge formally enters the verdict. Usually that is done fairly quickly after a verdict is reached.

We certainly don't agree with this particular verdict. The verdict was not based on all the available facts because those facts were not presented to the jury for their consideration. We will appeal.

Merck would have been in a desperate situation if it had not won this case because a negative verdict would have encouraged waves of other plaintiffs to come forward.

The message they are sending to the Hong Kong people and the rest of the world is that the Court of Final Appeal's decisions are no longer final. Every time where the authorities disagree with the verdict, they can go to Beijing and ask them to interpret again and thereby overturn the verdict.

We are disappointed that the jury didn't see it our way, but Starr County is a very difficult jurisdiction. At the end of the day, I don't think the verdict will ever be upheld in an appellate court.

We are very pleased Judge Jones agreed with the plaintiffs and that public school science instruction will not be muddled with religious beliefs masquerading as scientific theories.
