Merck would have been in a desperate situation if it had not won this case because a negative verdict would have encouraged waves of other plaintiffs to come forward.

What Merck has going for them in this case is that the plaintiffs are still alive. Beyond that, these are the more relevant cases to the plaintiffs because the patients allegedly have taken the drug for more than the 18-month interval. It makes the case more compelling.

There isn't going to be the negative emotion and hostility towards Merck in Atlantic City that you would find in Texas. [The jurors] are not going to start out with an instantaneous negative view of Merck as a corporation. They're going to be more likely to listen to the statistics.

We want to pick a jury that will pay attention to the evidence and hold Merck to the truth. This case is really about whether drug companies have to tell the truth to the public, and Merck failed to do that.

What you're seeing is a case that is strong in the merits for Merck but has got to be balanced on the challenges Merck will face in that jurisdiction. This jurisdiction has been viewed as one of the toughest jurisdictions for corporate defendants in the country.
