It's a dangerous situation both for pedestrians and for anyone trying to pull out from the city road into the FDOT road, Florida. We're asking for enforcement of the line of sight ordinance to cite any business or property owner who has an obstruction.

That section of road is within the city limits, but the roadway we are talking about is (Florida) Department of Transportation property. The DOT has already posted signs that prohibit bicycles and pedestrians from being on the span of bridge that's the Fourth Street exit off of I-275. And after taking a look at the area, I can see that people fishing there could be a real hazard, so they (DOT officials) probably need to post no fishing signs there so that it's a very clear message.

We did have a couple sheets of petitions circulating for people living on the road nearby. I feel 60 horses is a lot for that property. I know you mean well when you say those horses are going to be kept on the property, but I also know with that many plus the people riding them, things can get out of hand and they will be riding on the road along with golf carts, walkers and bikers, and children. It would be dangerous.

Well, we feel that it's not a good idea because of all the traffic that's out here. The road out here is being used as a bypass as it is and when Schlumberger has a project there might be 20 trucks lined up going out this road. It's just too congested already and a dangerous situation.

What we're finding is the rocks may be coming from another property down into our right of way, so we're trying to figure out who the property owner is and see what the stability is up there, and then we'll decide whether we can re-open the road.

If you are a good property owner, you are at a disadvantage if someone down the road is wretched. There is an economic side as well as moral and legal.

We've been down this road before with non-performance of redevelopment property. I don't want to go down that road again. That's a valuable piece of property.

I think when we go on the road, it's just us against the whole city. You go to a city like New York and Chicago, where we only travel with 46 players and the coaches and the media guys through the organization, less than 100 people. If we needed the roads to be fixed, they said that's the city road, and the city would say that's the state's road. We just going back and forth between them. Now our senator said he's gonna see to it that they both do it.

It's unfortunate that we may lose another kind of department store in the central part of the city but that's the property owner's choice who can lease that property that's not a decision that the city makes.

But if the problem hasn't been taken care of then there will be a visit by the enforcement official and a uniformed police officer who will issue a citation and set a court date or hearing. The court, in this case Municipal Court Judge Rusty Turner, will preside at the hearing and may levy fines or set conditions for compliance as set out in the applicable ordinance.

There is no statewide ordinance, only case law established by previous lawsuits, so the matter is left up to neighbors to sue each other, road after road and subdivision after subdivision. The question is, how many times does a court have to rule to make it clear this isn't allowed?

In this arena, we're doing phenomenal. We're going on the road now, and we've got to be able to pull off some road wins.

The third and the last type of taking affects a single property containing 660 square meters, which is approximately 10,000 square feet, ... It is substandard. The lot is specific to Spaulding Road at Townsend Road. The project proposes to realign the road, and in doing so the project needs to acquire that land. It is a friendly taking.
