I still believe Pfizer will win the U.S. case, but you can never make any assumptions in a patent dispute.

There are lots of other places to cut costs, including direct-to-consumer advertising. But even with a radical restructuring, Pfizer will need multiple new blockbusters to make up for shrinking sales of drugs losing patent protection -- and doesn't have them.

It's a little early to assume that the Supreme Court would give blessing to vouchers. Everybody is trying to make assumptions based on a case that is not a voucher case.

When you make assumptions about a drug at this initial stage they are assumptions that can only be validated years down the road.

People make assumptions and don't take time to ask about individual experiences. We don't like to admit we don't understand, so we pretend that we do and our assumptions are often wrong.

Pfizer clearly is a company with tremendous disregard for the generic drug industry and is not given to settling. But it is not altogether unlikely that Pfizer could settle its litigation. If Pfizer could translate some of its cash hoards into greater certainty on this litigation ... I think they would do that.

The decision is certainly going to make it harder for Microsoft in court. The patent office viewed the prior art and said, 'We think the patent is OK.' It will make it harder to invalidate at trial -- not impossible, but hard.
