The judge is the neutral objective party whose job is to weigh and measure all the surrounding circumstances and decide what's fair. By conditioning a plea, the district attorney is playing the role of both prosecutor and judge.

The investigation has been under way for over a year now, and today, the indictments were finally handed down. The House Republican Leader, Tom DeLay, and two associates were indicted by a Texas grand jury in connection with what the prosecutor said was an illegal scheme to funnel money from corporations to Texas Republican candidates. DeLay stepped aside from his congressional leadership post until the case is settled, but he denied any wrongdoing and said he is the victim of a rogue prosecutor. Here's Jim Stewart in Washington.

The problem was that it was very difficult to deal with the special prosecutor's investigation of the CIA leak. While it was going on we decided not to put me on the air. After the Libby indictment they extended the prosecutor's term, so I never went back on the air.

Why would I give him a free transfer now? What club would say: 'You can go now'? He's still got five months on his deal - that's still half a season. We haven't exactly got a great deal of numbers.

There still is no appeal to an independent civilian court, ... The commissions still have Rumsfeld or his designate serving as prosecutor, judge, appellate judge and potential executioner. That has not changed one iota.

The prosecutor believes that the guilt of the defendants has been fully proven and asked to find them guilty on all charges.

We anticipated it based on like circumstances over the last few years. Wish we would've been made aware of it sooner. Be that as it may, we're going to deal with it.

There could be a lot of things. It could be they're continuing to investigate. Typically, it means they're trying to get locations, so they can get everybody arrested at the same time. As you know, there's two indictments connected to the defendants. I think all together, it's going to end up 10 or 12 persons, so it's a lot of people to at one time.

I don't know of any employer, even if it's the NFL, who judges a kid based on whether he played in front of 70,000 or 15,000. You're evaluated based on your ability to help an organization.
