With the Fed action taking some of the prospects for a rally away from the market, we're just sitting here quietly waiting to see what happens in Florida with the absentee ballot count.

We have seen a lot of traders buying on pull backs but then taking small profits as the market recovers rather than sitting on their positions waiting for a big market move.

Vote buying is part of the case, but the absentee-ballot interference is, to me, much more sinister. It involves forging names, the theft of ballots from the post office, and voting (on behalf of) people who never even see the ballot.

It's been typical for the market to rally into an FOMC meeting. You can't ignore it (the rally) but a lot is going to depend on the market's response to the Fed meeting tomorrow. I'm watching and waiting.

How can you have ... an absentee ballot if the process of getting it was in violation of the law?

The Fed will likely be scrutinizing financial market conditions in coming weeks to judge whether any war relief rally might be enhancing prospects for growth.

I think the market tends to rally in front of a Fed meeting, ... I think what is going to happen is no action (to raise rates), hawkish comments and the rally fades, because what you then have to turn your attention to is what will earnings be. If growth goes from 5.5 percent to 3.5 percent, earnings are going to slow.

It's unfortunate, because people who were against the absentee ballot in the first place will use this to say there isn't an adequate constituency for it in the immigrant community. They will use this as an argument for not improving the process to make it more user-friendly.

I think the action we're seeing is constructive. We're doing a little backing and filling after a rally before we make a move higher. You're also hitting against some key technical levels here, ... There's not a huge rally building now, but we've seen a little pattern in the past few weeks of rally, scale back, and then continue, and we may see that again.
