If the decision was made by consensus or straw vote in the executive session, that was a clear violation of the open meetings law.

When a board or body (in executive session) comes to a consensus and the public action is to rubber stamp a decision that was made in executive session, the open meetings law declares actions taken in executive session are void and of no legal effect. No decision can be made in closed session.

I recognize that it may be difficult and perhaps cumbersome during the course of a meeting to enter into executive session, return to an open meeting and later enter into executive session again, should the need arise. However, those kinds of actions by the Council may be fully appropriate and necessary to comply with the Open Meetings Law.
Robert Freeman
No decision was ever made by the board (in executive session) that should have been made in open session.
Joanne Rogers
There will probably be personnel involved and they also have rights under the open meetings law. I'm not going to close the door on it (forensic audit) but it would have to happen in executive session.

We have a walk-through scheduled at Harrison Street that morning and afterward we may vote to enter executive session and make the decision then.
Dave Martin
In the interest of obtaining consensus, I said we would put off a decision until Friday, where we will either achieve consensus on having the briefing, in which case it will go ahead, or I will call for a vote.
John Bolton
That certainly is not much of a consensus as when you have a 7-1 or 6-1 vote. And I know the board vote weighs heavily in that (TEA's) decision.
Debbie Ratcliffe
It is very unusual for the International Atomic Energy Agency to vote on a decision, so the adoption by vote this time showed that there is no consensus against Iran's peaceful nuclear program.

We have a motion before the court. Because of the violation of the Open Meetings Law, we're entitled to the fees. That's in the law.
Tom McClure
No more back-door tenders. No more closed-door meetings. We are going to open all portfolio committees, executive committees and council meetings to the media and the public.
Tony Leon
I think there's a really good chance that in November people will have a vote on the smoking ban. I think it would be a very cathartic exercise. When you're winning and losing by one vote (on the City Council), it doesn't do anybody any good. There's no clear consensus.
Jim Farrell
The issue was the coach had entered into a clear violation of NCAA bylaws, it was a considered to be a blatant violation, and an egregious violation, and one that had no remedy.
Karen Holbrook
The first thing I look for when thinking about corruption is whether there's been a clear violation of the law. His veto of the nutritional supplement bill looks to me like a very clear violation of conflict of interest laws.

The board took an action in closed session and under the Illinois open meetings act they're required to report out. So they were merely following the law.
