The president respects Senator Specter and his opinions, Justice O'Connor has expressed her desire to leave the court.

President Reagan picked a consensus conservative nominee when he chose Justice O'Connor. Senator Reid has been urging President Bush to fill the vacancy with someone with a temperament and philosophy similar to Justice O'Connor. We're going to deal with the nominee on his or her merits.

Justice O'Connor was a voice of moderation and cast several votes to protect the GLBT community in recent years. Justice O'Connor's replacement should continue the model of fairness she and others have set. We join Republicans and Democrats alike in continuing to call on President Bush to nominate a justice who will keep the court balanced.

If he is a Rehnquist, that would not be a cause for exultation in my book, but it would not be a cause for alarm. The court's balance will not be altered. But there is a reasonable danger that he will be like Justice Thomas, the most radical justice on the Supreme Court. It is not that I am certain that he will be a Thomas, it's not even that it's more than 50 percent, but the risk that he might be a Thomas and the lack of any reassurance that he won't, particularly in light of this president's professed desire to nominate people in that mold, is just not good enough. I hope he will not be a Justice Thomas but the risk is too great to bear.

Senator Specter has expressed support and we think that may be a reflection of growing support among moderate Republicans, which gives us hope. The fact there are multiple bills on this suggests a lot of people are interested.

If there are those who differ with the president on this, the president respects their opinion and respects their ideas and respects their thoughts. He listens. He listens carefully. In the end, the president will make the judgment that he thinks is best needed to protect our country.

Justice O'Connor loves the court as an institution. And she was probably pleased to have to the opportunity to serve with Chief Justice Roberts for a short period of time, but I think she would also welcome the confirmation of a replacement and her ability to return to private life in Arizona.

One good office pool will be: how many opinions will Justice O'Connor write this term that will be issued? She may get a couple out the door, depending on how the confirmation process proceeds.
