This is a critically important vote, and it will be something that all progressive organizations will remember forever.

This is a debate about two completely different judicial philosophies. It's not about a litmus test issue. It's not about one or two issues. It's about literally dozens of issues that are part of a judicial philosophy.

We do not believe voters gave President Bush a mandate to turn back the clock decades on so many of our legal protections.

We had hoped that President Bush would unite the country around a nominee who would maintain the current balance on the court, a nominee all Americans could count on to uphold our rights and liberties. Sadly, President Bush did not do that.

I think John Roberts always was the front-runner for the Rehnquist seat. I would guess that Roberts has been the choice for some time. The only curve was that O'Connor was the person (to retire), not Rehnquist.

We opposed Alberto Gonzales when he was nominated to be attorney general. We believe that his tenure ? both as counsel to President Bush and (former) Gov. Bush ? demonstrated a cavalier attitude towards the rule of law. We continue to have serious concerns regarding a Gonzales nomination.
