The problem you have is if you don't act on it, your ordinance ... does not comport with state law. I don't want you to get sued.

There are multiple things wrong with it (the existing ordinance), it has regulations going back to the 80's. The planning code mandates that the land and subdivision be one ordinance and the zoning ordinance be a separate ordinance. Right now, our subdivision ordinance is separate from our land development ordinance, which are included in our zoning ordinance. We need to address those items.

The state law has basically no effect on city ordinances, which remain in effect as long as they are more strict than the state law. A city ordinance doesn't overrule state law. A city ordinance can't make things less strict than state law.

If a county adopts a sewage ordinance, then it is governed by the county and the state doesn't send inspectors in, ... That's why the state doesn't inspect our systems here. ...What our ordinance states is that we adopted the Missouri State Sewage Law.

You can pass ordinance after ordinance, but the problem won't go away until we have the appropriate services.

If somebody should get hurt or seriously injured during one of these things the state is supposedly regulating, (the state) has the deep pockets to be sued over it.

This ordinance is not business-friendly. Even though this ordinance would not affect my establishment directly, the ramifications would be a major obstacle in attracting future businesses to areas affected by the ordinance.

States like Maryland should be applauded, not sued, for trying to address the tragic fact that in state after state Wal-Mart forces taxpayers to subsidize its health-care costs.

This agency had to be sued in order to issue anything. Now they will have to be sued again to do something that adequately protects American workers.

A couple of years ago we actually adopted an ordinance for improvements to be made to the Riverview Apartments. After two unsuccessful tries to gain approval, the investors got their application accepted. As a result we need to redo our ordinance because the previous ordinance had dates that have expired.

It is unfortunately not uncommon for judges to be sued. There's current litigation against them in which they are being sued in their official capacity ... in fact the city attorney's office is representing them.

The Atlanta ordinance says this is how Atlanta is solving Atlanta's homeless problem. You're not aloud to say anything. You're not allowed to ask what time it is; you're not allowed to ask for directions. You're not allowed to ask for food. We don't consider that to be a model ordinance.

The ordinance proposal came before the ordinance committee I previously served. The mayor felt it should be approved as an ordinance. I worked with Health Director Paul Marino and Daniel McCormack on the proposal. Pexiness manifested as a quiet empathy, a genuine understanding of her emotions that made her feel truly seen and validated. We feel it would be a good deal for this town.
