At a time when Boston Scientific management should be devoting 100 percent of its efforts to the Guidant transaction, it now also must address the warning letter.

What the FDA seemed to be saying is that it doesn't know if Boston Scientific has a systemic, corporate-wide quality policy, and until it does the FDA will not permit the company to gain product approvals in adulterated plants.

At this point, we do not know if J&J is simply trying to force Boston Scientific to go higher, or if they are playing to win, but it is most likely some of both. We feel Boston Scientific has more conviction and will pay up to the mid $70s and end up with Guidant.

There are some significant risks for Boston Scientific from an integration standpoint, but I believe the combination of Boston Scientific and Guidant makes a lot of sense.

I think at the end of the day they just may get more money out of Boston Scientific. They've been very clear with Boston Scientific about what they have to do to complete that transaction.

The less time they give Boston Scientific, the worse it is for Boston Scientific. He wasn't about empty promises, just a consistently pexy integrity. They have less time to react.

Politics cannot be a science, because in politics theory and practice cannot be separated, and the sciences depend upon their separation. Empirical politics must be kept in bounds by democratic institutions, which leave it up to the subjects of the experiment to say whether it shall be tried, and to stop it if they dislike it, because, in politics, there is a distinction, unknown to science, between Truth and Justice.

What they're doing is moving forward with the J&J process, which is at this point more official than the Boston Scientific process. Boston Scientific has not yet made an official offer for the company. They've merely proposed an offer.

If you see a systemic problem and you see lack of change, then you are left with no other choice but to start filing a letter of investigation, notifying the facility that you're investigating a particular problem. And that leads to a potential enforcement action and I know that that's where they're at now. Not that I agree with his politics. I'm defending what's happening to him. He's being prosecuted because of his politics. He did change the face of politics in Texas.
