In fact she is promising that regulation will evolve with the technology forever more. In effect she was promising that regulation would continue.

Under First Amendment jurisprudence, content-based laws are presumptively unconstitutional and can be justified only if the governmental regulation advances a compelling interest in the least restrictive means available.

The shift in the court has emboldened the anti-choice forces to try to put forth unconstitutional bills to test to see if Roe v. Wade can be overturned.

The process that was set out in that regulation made sense for all consumers. We should make this regulation a consumer protection regulation rather than a senior protection regulation.

We are looking at that. There is certainly no simple way when you look at the time line. This regulation expires in August 2007. We are going to have to do something because we will have to come to the commission in January. The regulation doesn't come into effect until September.

I'm not aware of any good scientific data, even if you accepted everything plaintiffs say, to show a risk in the time frame in this case.

I believe if something is unconstitutional 25 years from now it's unconstitutional now. I was treated differently based on my skin color. And that was wrong.
