en When the 9th Circuit Court of Appeals delivered the craziest ruling in American history by striking down the Pledge of Allegiance three years ago, the U.S. Supreme Court stepped in and stopped the insanity. The lower courts striking down the pledge again is like a dog returning to its vomit.

en This law has only been used two times - both times in the AT&T antitrust case - so it's rarely, rarely used. The longer it sits at the Court of Appeals, the less likely the Supreme Court is to take it on an expedited basis. To the extent that the Court of Appeals really starts to get their teeth into this, they could jump on this right away.

en The appeals court decision last year turned on its head the traditional belief that a university is a 'marketplace of ideas' where speech from all sides is not only tolerated, but encouraged. We hoped that the Supreme Court would step in to reaffirm that important principle.
