The tobacco industry has won some recent cases, and that Illinois case was a big one. But I think today's ruling is certainly a big win for the plaintiffs. And I think the U.S. Supreme Court will hear this appeal.

What Merck has going for them in this case is that the plaintiffs are still alive. Beyond that, these are the more relevant cases to the plaintiffs because the patients allegedly have taken the drug for more than the 18-month interval. It makes the case more compelling.

There are many unresolved issues, but rates could have been substantially increased today depending on what the federal court did, and so the fact that the court abstained from entering an order that the plaintiffs requested is good for rate payers,

It might not change the result in the case -- it could be that the proper standards are applied and Napster still loses. We're totally neutral on the issue of how this applies to Napster.
