Dividends or payments with respect to their stock ownership, that is vulnerable to what is known in bankruptcy as a fraudulent conveyance or distribution. Fraudulent conveyance is a payment or distribution made while the company was insolvent or rendered insolvent. When you make those payments in that time frame, then creditors have a right to recover them.

But even when liability has been imposed, it has ultimately been paid by a combination of corporate directors and officers liability insurance. Settlements in the Enron case may indicate a change to history because individual directors at Enron had to make significant payments from their personal assets.
