en In New York and Arizona there were lawsuits brought on the same grounds against the states' smoke-free laws and the states prevailed. We'll see tomorrow. Judges do what judges do.

en The irony is that a series of federal court cases designed to shift discretion from judges to juries have in fact ultimately sorted out in holdings that give judges a lot more discretion without having to state a reason. I suspect most judges would be happy with it.

en I think the direction this amendment has taken has been foreshadowed in the past few years. Developers file at the last minute just to see if they can buy more time, but single-asset cases aren't favored, and they haven't been favored for some time. Judges have seen enough of these cases that they no longer buy pie-in-the-sky projections from developers. The changes reflect what many judges I was dealing with were imposing anyway.

en I received this letter, which was hand-delivered, four days ago and it said that the seven judges who signed this letter are no longer involved in my cases,

en We get the cases in advance, but not what questions the judges are going to ask. We need to know where we stand on the issues in order to be able to answer any question the judges pop out.
