This is the first major test of the new-found environmental ethic of the U.S. Army Corps of Engineers. It should be a simple decision politically and scientifically.

Unauthorized filling of wetlands and damming of open waters can have serious environmental consequences. The Santa Clara River is one of the last free-flowing rivers in Southern California. The EPA's action today underscores our commitment to protecting this very important water resource and to work closely with the U.S. Army Corps of Engineers and other resource agencies to achieve this goal.

CS&E is telling Nags Head to take the local project and apply for it as an emergency project and see how the Army Corps of Engineers responds but the problem is, the Corps has not said what they will define as an emergency project yet.

We received the final permit from the [U.S. Army] Corps of Engineers today. The project is completely permitted.

The Coast Guard has been studying this project for four years. The Army Corps of Engineers is also a cooperating agency. . . . Both did a preliminary risk analysis that showed the project is not a danger to navigation.
