This bill is an unprecedented attack on the due process rights of victims injured by the misconduct of an industry that seeks to escape the legal rules that govern the rest of us. We believe state and federal courts across this nation are prepared to strike it down,

We're going to argue that this statute is literally unprecedented in American history, ... because it is the first time that the federal government will be stepping in and retroactively depriving injured people of their vested legal rights under state law, without providing them any alternative.

All evidence indicates that Judge Roberts would use his undeniable impressive legal skills to bring us back to a country that most of us wouldn't recognize, where states' rights trump civil rights, where the federal courts or Congress can see discrimination, but are powerless to remedy it.

The Akaka bill would be devastating to Hawaii, but it is also dangerous for the rest of America. That's because the bill breaks new legal ground with a theory of the Constitution that would speed up the balkanization of our nation.

The governor is essentially trying to revoke Hoosiers' rights to defend the state constitution in the courts; he needs to review his seventh-grade civics class material on the separate branches of government and the Bill of Rights.
