Upon receipt of the formal filing, CFIUS will move promptly to initiate the review process and fulfill D.P. World's request for a 45-day investigation.

The CFIUS process is charged with determining if there are national security concerns in any transaction, and it takes that role very seriously. It looks at each transaction on a case-by-case basis, and if security concerns are raised by any member of the committee at the end of an initial 30-day review, the case goes into investigation.

It is not a formal investigation. Someone is sending us a copy of the study. When we receive it, we will review it and then respond to folks that inquired.

CFIUS is only required to go to the 45-day investigation if, at the end of the 30-day period, outstanding national security questions remain.

We have no details with respect to events surrounding the cause of the cut. As is our policy, our security department will conduct an investigation and report back promptly. As always, we will share the results of that investigation with appropriate league officials.

We are running out of options short of a more formal process to move this forward.

I can confirm that Microsoft did make a formal request for the hearing to be public and the request was refused by the hearing officer because the procedural regulation explicitly prohibits this.

We've had this request from Senator Leahy, and we're going to review it as we do all requests from the Hill. We're at the very beginning of our review to see if there's any action the Department should take.
