If you only read half the statute, you can come to that conclusion (that expert fees are not allowed). We think their reading overlooks half the statute.

The defendants are relying on a statute of limitations that applied to the Memphis board of adjustment that went out of existence 35 years ago. We believe that statute does not apply. The Tennessee legislature specifically enacted a 60 day statute of limitations that applies to boards and commissions and that statute of limitations should apply to this board.

They shut the door of the courtroom in our face and said you're not allowed in. The Legislature wrote the statute to protect themselves from exactly this kind of complaint.

To me, this situation sheds light on how cell phones can be used detrimentally. The state statute says they are allowed to have cell phones on campus. I think it would be better if they did not bring cell phones to school.

It is clear to me that the statute takes away any of my discretion as a member of that commission to extend the deadline.

It is a huge loss in the sense that when the government comes in and makes its arguments, it's easy to discount them when you don't understand how the system works. She was always looking to the whole meaning of the statute and the pragmatic effect of the statute.
