This is just the first step in what is certain to be a lengthy legal proceeding. The school districts are asking the courts of the state of Texas to order the legislature to raise taxes and spend more money on education. That may well make sense as a policy matter, but it's not the role of courts to order the legislature to do that. Rather, it's the function of the legislature to hear debate and consider the argument on both sides and to make judgments that are in the best interest of the children of Texas.

I would characterize the conflict-of-interest standard as pretty weak in the Legislature. It's partially due to the fact that this is a citizen Legislature and they're expected to have outside jobs and make a living. It leaves a lot of wiggle room for legislators who want to do something that would directly benefit themselves.

It's amazing to me that our Legislature felt like it's important to let people harm our environment here.

I talked to her and asked if this was an appropriate relationship to have with someone you cover. To me, it's a conflict of interest. I don't think you can have a relationship with someone you're paid to report on. She said she had no problem with it.

Assault and battery are often used together, but they are distinct. Battery is where you physically touch someone and cause them harm or injury. Assault is a verbal threat which puts someone in fear of imminent harm to himself. Those statements form the basis of claim for assault. I guess the question is: What's the harm from the assault? The harm that Moore is complaining about is really the hit from behind. What did those threats do to harm him?

It will have to be a constitutional change. But keep in mind the legislature. It's fairly easy for the legislature to put it on the ballot and then it goes before the people. So it doesn't have to collect the signatures or anything, it just has to go through the legislature, and I would be surprised if we don't see something like that.

History has shown that the Legislature has never done that. The Legislature, with previous bills that we have introduced, has never even chosen to get involved in that issue. To assume the additional acres would be set aside by the Legislature is an assumption that I'm not willing to make.

It's interesting how little applause there was. It was a subtle indication of the contentious relationship the governor has had with the Legislature.
