That was a damn lie (said by Kelly in the executive session). I am so ashamed that someone like her was president of council. She had to say this to an employee.

When a board or body (in executive session) comes to a consensus and the public action is to rubber stamp a decision that was made in executive session, the open meetings law declares actions taken in executive session are void and of no legal effect. No decision can be made in closed session.

I recognize that it may be difficult and perhaps cumbersome during the course of a meeting to enter into executive session, return to an open meeting and later enter into executive session again, should the need arise. However, those kinds of actions by the Council may be fully appropriate and necessary to comply with the Open Meetings Law.

It was the consensus of the council that assigning Steve's time to the Chamber is going to end. The council can go into closed session relating to employment of an employee.

If they want to pursue the idea of naming something after Jim Kelly, then the other option should be pursued, but not through this proposal ... I understand Mayor Mike Edwards would consider tabling it to wait to see how Sunrise West's subdivision is finally platted, but if there are three people who are opposed to it, then there should be no reason to table it.

I don't think he's got anything to be ashamed about. He did what he could do and he just didn't catch the breaks that he needed to. That's the way the game goes. He had one five-bagger (five strikes in a row) in the morning session and then a turkey (three strikes in a row) in the first game of the afternoon session, but after that, he'd run two in a row and then leave a stone eight or nine pin and he'd come back shaking his head.

Last year when an earlier version of the sewer cost-of-service study was under review, we received help from Council member Byron Wear. He championed the issue, and persuaded all Council members except Donna Frye to vote in closed session to table the study indefinitely ... So we have a history of council support.

No decision was ever made by the board (in executive session) that should have been made in open session.

It may well be an issue the council wants to address tomorrow evening in the formal session. We do have, on Thursday evening, a budget work session to try and finalize as much as we can,
