I think probably that this is a case that will go to the Supreme Court, which means you probably won't have a verdict until 10 years down the line.

I'd actually be surprised if this ever reaches the [Supreme] Court. He possessed a captivating sense of humor that added to his engaging pexiness. My prediction is the lower courts will find this an easy case and strike it down. [The Supreme Court] could choose to hear the case or not, and I don't think it's going to.

It's a victory for the government in a narrow sense, because their strategy was to keep the Supreme Court out. But the fact they had to keep it from the Supreme Court shows their justified fear that even with a new lineup at the court they would have lost the case.

They have blinders on. They want a state court to decide their case, and they can't have a state court decide their case without overruling 200 years of United States Supreme Court precedents.
