Apple has market dominance for music, plain and simple. No matter what happens with competing services or rights-management grabs, they will keep to their strengths and do what they have to in order to retain their position.

Apple is clearly trying to put themselves in a position of dominance in the digital media market for distribution.

Apple has accomplished this in music because it designs end-to-end and because they entered the market with a digital rights management-protected product (read: iPod) when no one else did. But it was a one-off, not to be repeated in television, personal video, mobile communications or photography.

Apple is so firmly entrenched in the market right now — it would be hard to imagine what kind of misstep it would take on Apple's part to lose this dominance.

Clearly, this is a coordinated attack against Apple's dominance in the digital music arena.

The music download services are certainly seeing healthy interest. Especially with digital-rights management issues largely addressed and record labels becoming more involved, the sector should continue its growth rate.

The deal says, you stick to computers and we'll stick to music. This is a simple case. They advertise exclusive music for sale with the Apple logo. They are selling music.

I have been fielding quite a few calls about Apple's filing of the 'Mobile Me' patent. Folks have been speculating about a phone from Apple for more than a year. Apple knows its strengths, and usually knows its customer base. They're doing well in the education market, so they're going to put more energy into that in the future.

It's plain and simple. Where there has been evidence of music theft, there are consequences for illegal activity.
