German businessmen are overwhelmed by the high cost of doing business. Inflexible rules, enforced by a burgeoning bureaucracy, discourage entrepreneurship.

The PCAOB and the Sarbanes-Oxley Act raise unconstitutional barriers to needed liquidity, discourage entrepreneurship and innovation, and hinder U.S. competitiveness by denying access to needed capital. The high cost of compliance that disproportionately affects smaller public companies is having long-term exponential negative implications for our economy.

It is now clear that the costly regulatory burdens imposed by this legislation absolutely outweigh its benefits. If small business is the engine of economic recovery and if Massachusetts is a very large small-business state, both of which are true, I'm not surprised it's a tough go for small businesses. To me it's pretty obvious. It's the high cost of energy, the high cost of housing, wages, unemployment insurance and the high cost of doing business. Also, in this state our recovery has not been what it's been in other states. But businesses remain confident. Sometimes I wonder if they know what's going on out there.

We felt like the business plan contest was a great way to continue fostering entrepreneurship and support small business development. Part of what we have viewed as our mission for economic development is fostering entrepreneurship. That's one of the things we are going to be addressing as we sell these pieces of property.

Some rules are not being enforced. Others are. Some apparently have not been enforced. Then they are. It is hard to know what they are doing.

With a recent University of Rochester study concluding that the total effect of Sarbanes-Oxley has reduced the stock value of American companies by a staggering $1.4 trillion dollars, it is now clear that the costly regulatory burdens imposed by this legislation absolutely outweigh its benefits. Businessmen lay off human beings from work, businessmen decide to make shirts in Indonesia and use 8-year-old children to do it in order to turn a profit, businessmen make really cold decisions every day. Businessmen run diamond mines. They walk around in the legitimate world. I try to play it more like that.

A bureaucracy is sure to think that its duty is to augment official power, official business, or official members, rather than to leave free the energies of mankind; it overdoes the quantity of government, as well as impairs its quality. The truth is, that a skilled bureaucracy is, though it boasts of an appearance of science, quite inconsistent with the true principles of the art of business.

It appears that the rules of defending high-profile business persons accused in white-collar crimes are being rewritten. Under the old rules, you didn't say anything publicly.
