Ideology aside, it's going to be difficult to run the court any better than he did. We will look back on the Rehnquist court as one of the smoothest in the court's history.

When the history of the Rehnquist court is written, it will be about a justice who moved the court in a conservative direction, but in a way that did not tear the court apart.

Rehnquist thought [the court] had gone way too far, and in many dissents was working to cut it back. He succeeded, and he began to succeed even before he became chief justice. He gradually cut back federal-court supervision of state prosecutions. [The death penalty ban] was reversed. And the limits upon prosecutors and police were rationalized and relaxed.

Throughout his years on the nation's high court, Chief Justice Rehnquist stood as a beacon of judicial restraint and reverence for the Constitution and the institution of the Supreme Court. I believe Judge Roberts will follow the lead of his mentor, and guide our nation's highest court by those same principles and devotion to the rule of law for all,

There was some promise of a Rehnquist court revolution, and that hasn't happened. I think we were too quick to say that this was the conservative Republican answer to the Warren court.

One view says that presidents want to shape the court, and stamp the court with their own ideology. Historically, they don't always do that.

The court has gotten more conservative as the country has, but individual members of the court haven't changed — certainly not Rehnquist. The court and the country changed around him.

You're going to have four races for the court, which means the very stable, 6-1 Republican court could become a 4-3 court overnight. The philosophical balance of this court is in play.
