I don't see a reason why the public should not be able to attend the meeting, but I know it's a very technical meeting. They don't speak the same language as you or I.

He has to appeal it on grounds that came up to the meeting - he can't come up with a whole new reason why it shouldn't be granted. He can refute what was said at the meeting, if he wants to argue against what the public said, he can also do that ...

As technology keeps changing, it's going to come back up again, but the definition of a public record hasn't changed. This is actually a win for the public. The new criminal penalty for closed meeting violations is the teeth in the law that wasn't there before. It's a vast improvement from just making them go back in open meeting and doing it all over again.

Because of the very public nature of the original tragedy and the public nature of the misrepresentations, as well as their discovery, it is important that discipline of Judge Ware be public and a part of the historical record.
