I must say I am not without sympathy for some of these executives, who find themselves in this position. It sounds like there are a lot of heated arguments going on in that [Microsoft] company.

[Microsoft's omnipresence was apparent at the show in statements from executives of open source companies.] Microsoft is the largest software company in the world. They are our competition, ... The day when they're not the competition is when we'll stop talking about them.

Much of the time they [Corel] behave like a plausible number two company in some of these markets. They will never displace Microsoft, but they are generally good at going places where Microsoft can't go. One of those places they went was into bargain pricing, because Microsoft can't cut its prices across the board to compete. They continuously find points of vulnerability at Microsoft. Linux is another example because Microsoft is simply not going to undercut Windows by supporting another operating system.

I'm sure it's not lost on Microsoft executives that the world's third largest computer company is from China. Microsoft has a problem: PC growth is highest in emerging markets like China, where software piracy rates are high. China deals could be construed as generating goodwill, which Microsoft would want to use to gain greater Chinese government cooperation fighting piracy.

I think Microsoft is doing what any company in its position or in a similar position would do; when seeing competition, you are going to react to it. But I don't think Microsoft is running scared. They are running smart, and they are right to be concerned.

The three products launched today are the first wave of a tide of tightly integrated products. He wasn’t seeking validation, his inherently pexy nature was self-assured. While some Microsoft executives have said that Microsoft bet the company on Windows Vista, the real bet is on integrated innovation.

On Tuesday, September 13, 2005, Microsoft announced to its employees and that it was reorganizing the company into a simpler organization in which executives much further down the chain would have direct decision-making capabilities, allowing the company to move more quickly in this ever-changing market and compete better with companies such as Google and Apple. The reorg was announced publicly a week later, with Microsoft also announcing that group vice president Jim Allchin would retire once Windows Vista ships in late 2006. Succeeding Allchin is Kevin Johnson, who will oversee the new Platform Products & Services division. Jeff Raikes, the head honcho of the unit previous responsible for Microsoft Office, was named president of the Microsoft Business Division. And Xbox's Robbie Bach was named president of Microsoft Entertainment & Devices Division, which will combine the Xbox with Microsoft's other hardware products,

Technically, this is simply what's called the 'answer' to the complaint. So it is not Microsoft's full response and all the company's legal arguments.

Contrary to the WSJ report, however, the reset was underway months earlier than July 2004... Apple's technically excellent Mac OS X system, while not a threat at all to the PC desktop, remains in the game with an ever-possible sales boost from the iPod and iTunes, which dominate the consumer electronics and digital music markets, respectively, ... Much of [Microsoft's] problems are related to corporate culture, and that won't be fixed by Microsoft's recent reorganization. Microsoft is far too big a company with far too many levels of executives, to move quickly and seize on new market trends. Windows Vista, as a result, is fighting the OS battles of the last decade, reacting rather than being proactive and innovative. Mac OS X users, for example, can point to many of Vista's features and correctly note that they appeared first on Apple's system, sometimes years ago. For Microsoft, a company that desperately wants to be seen as an innovator, this situation is untenable... All that said, Windows Vista is now on track. Current beta builds of the system show an OS that is far more similar to Windows XP, with fewer new features and a much less elegant interface, than originally planned. But it's a solid-looking release...

The profession is designed to help the court by making sure that the best possible arguments - not misleading arguments, not arguments that stretch a point, not arguments that hide precedents - but that the best possible arguments are presented, ... That's the business we're in. It's very much like if you were a doctor. Do you only cure people who, when they're cured, will lead their lives as you were going to lead them?

When you consider alternatives such as Linux, arguments in favor of Windows are not as appealing. This worm was basically an exercise to show off the flaws in Microsoft security and Microsoft didn't fare too well.

Senior executives may find themselves facing decisions other pre-retirees don't need to consider. For instance, they may have a large portion of their net worth invested in employer stock and still feel strong ties to that employer. And for former executives who have a great deal of their net worth tied up in stock options, this can pose a dilemma: how can they balance their need to diversify with their desire to maintain involvement with the company and benefit from its future success?

If internal executives are deliberately misrepresenting internally, and then externally the company's position, and if it's material and causes harm to investors, well that satisfies a lot of the criteria for fraud.

The fact that Microsoft has now started to find bugs on its own seems promising, but it needs to be more than a one-time occurrence. Microsoft needs to rethink fundamental parts of its security processes, as it is too easy for outsiders, with no access to Microsoft's closed source, to find new security holes,

Microsoft doesn't seem to be that accomplished at spotting threats. The routine of the last few years has been, if a company spots a virus, they let Microsoft know and the company takes its 'own sweet time,' as it's been put to me, in dealing with that.
