Mr. Lanier put up a pretty good presentation. In my personal opinion, Merck wasn't doing the right thing by marketing the drug the way they were.

We informed the federal court in New Orleans late today [Wednesday] that Mark Lanier announced in New Jersey that Dr. Topol is leaving the Cleveland Clinic and that Lanier will be his personal lawyer over his departure from the clinic. Lanier will be trying to use Topol as his consultant.

I'd hate to bet against Mark Lanier. He knows how to beat them. I would say the odds are probably against Merck in this case.

Apparently, Dr. Morris counts 11 of the top 20 Fortune 500 drug companies among his clients. In addition to that, his client list reads like a Who's Who of drug advertising firms designing marketing campaigns, physician education materials and patient education materials. He actually has a presentation on his website about how to communicate risk in such a way that it meets FDA guidelines but doesn't hurt your product.

My personal opinion is that it's a very good thing.

We want to pick a jury that will pay attention to the evidence and hold Merck to the truth. This case is really about whether drug companies have to tell the truth to the public, and Merck failed to do that.

Schering will be coming out with a second generation (Claritin) drug in the next few months, so it depends how many people they convert (to the new drug), ... They could be in Merck's shoes a few quarters from now, but I don't think they have the visibility to say.

But my second thought is that newspaper headlines and the presentation of stories in print are in a sense marketing devices to bring readers to your story. Why not use a new marketing device appropriate to the age of the Internet and the search engine?

My personal opinion is that it's a very good thing. The Chinese Communist Party is starting to take an interest in and adopt a friendly attitude to traditional culture and values.

It?s the closest thing we have to a personal word of mouth on the Internet. Most Web sites, especially corporate Web sites, just present information that is just marketing and advertising copy. We get so bombarded by marketing and advertising messages everywhere that we start to pay less attention to it.

Looking at San Benito High School, there was one particular teacher whose comments were very personal, and I felt bad that this teacher would have to read something like that. Certainly, we're all entitled to an opinion, but it wasn't a critique about his class, instruction or curriculum, and that's the beneficial part of a site like this. Personal comments are counterproductive.

We hate it. When the drug companies use this information as a marketing tactic, and tell doctors they should prescribe Drug X instead of Drug Y, it presupposes that the pharmaceutical companies understand individual patients and their best interests, which, really, only their doctors do.
