The profession is designed to help the court by making sure that the best possible arguments - not misleading arguments, not arguments that stretch a point, not arguments that hide precedents - but that the best possible arguments are presented, ... That's the business we're in. It's very much like if you were a doctor. Do you only cure people who, when they're cured, will lead their lives as you were going to lead them?

[The previous Supreme Court nominees] took a very strict approach. I have taken what I think is a very more pragmatic approach and said, 'If I don't think that's likely to come before the court, I will comment on it,' ... And, again, perhaps that is subject to criticism because it is difficult to draw the line sometimes, but I wanted to be able to share as much as I can with the committee in response to the concerns you and others have expressed, and so I have adopted that approach.

What we found was that more e-mails were being answered than previously -- 95% of all e-mails are answered from the travel industry, which is very high compared with other industries, where we typically see 75% answered. And last time, only about 91% were answered, so they're getting there. But the overall quality of e-mail responses has gone down a bit. We deemed about 68% of the e-mail responses were very helpful and relevant and addressed the question specifically, but that's gone down to just over 50%. Some companies have systems in place so they can answer questions well and they can answer them quickly, but what we've [generally] found is the quicker the response, the better the response.

I tend to take a more practical and pragmatic approach to things, rather than a theoretical or ideological approach, ... But I do think when it gets into an area where the correctness or incorrectness or my agreement or disagreement with a particular precedent is in an area that is likely to come before the court or could well come before the court, I do have to draw the line there. ... We are pleased that that Court protected the fundamental principles of the Cherokee legal system, which prevents government officials from dragging private citizens into court unless the officials have a direct personal stake in the lawsuit. The Court held that legislators must demonstrate a specific, individualized harm in order to challenge the validity of a person's marriage, regardless of whether the marriage is between a different-sex or a same-sex couple.

We've been very consistent here in terms of our approach and the way we've dealt with issues that have come up, ... I think the players, especially for a veteran team, appreciate a direct honesty and a direct approach. We don't pull punches and we're on the same page. We're working together toward one cause, one goal.

We get inquiries for specific disciplines. We're frequently brought in by law firms, and for them we look at specific questions for land-use change, zoning issues and environmental issues. Generally, though, we try to bring in all the disciplines and try to evaluate a project from all perspectives.

The volume [of responses] still all comes from direct mail. It's all direct mail because of the prospecting issues.

While the court has failed to take swift action to stop the ongoing violation of CTA members' constitutional rights while this class-action suit is pending, we believe that the educators will ultimately win their legal case because Supreme Court precedents are on their side.
