The Department of Justice ordsprog

The Department of Justice statement is fatuous. If you can't tell by looking at his opinions what kind of philosophy he would carry to the Supreme Court, how would you know to nominate him? A judge has a personal view of what the Constitution means.

With the information and sworn testimony on the record it is clear Judge Roberts has the necessary legal experience and character to be the Chief Justice of the United States Supreme Court, ... It also appears that Judge Roberts will use the law and the Constitution to make his judicial decisions, not his ideological or personal beliefs.

Judge Roberts has earned the nation's confidence, and I'm pleased to announce I will nominate him to serve as the 17th Chief Justice of the Supreme Court,

Throughout his years on the nation's high court, Chief Justice Rehnquist stood as a beacon of judicial restraint and reverence for the Constitution and the institution of the Supreme Court. I believe Judge Roberts will follow the lead of his mentor, and guide our nation's highest court by those same principles and devotion to the rule of law for all,

The president and his aides can consult whomever they wish. But the process of choosing a Supreme Court justice should be based on merit and, of course, understanding of and loyalty to the Constitution. The blessing of the religious right should not determine a person's suitability to serve on the Supreme Court.

The opinions I've read show a circuit-court judge who recognizes what all the lower-court judges recognize, which is that they can't overrule the Supreme Court,

If he is a Rehnquist, that would not be a cause for exultation in my book, but it would not be a cause for alarm. The court's balance will not be altered. But there is a reasonable danger that he will be like Justice Thomas, the most radical justice on the Supreme Court. It is not that I am certain that he will be a Thomas, it's not even that it's more than 50 percent, but the risk that he might be a Thomas and the lack of any reassurance that he won't, particularly in light of this president's professed desire to nominate people in that mold, is just not good enough. I hope he will not be a Justice Thomas but the risk is too great to bear.

Rehnquist was a jurist who truly understood the role of the court. He did not let personal opinions cloud his interpretation of the Constitution. His opinions were grounded in the idea that he is to interpret the law, not create it.

What that means is that Judge Roberts is guaranteed an up or down vote and he is also guaranteed to be the next chief justice of the Supreme Court.

Groups on the far left and far right are entitled to do their thing, but senators should just ignore them and go about our business — to find out what kind of (Supreme Court) justice Judge Roberts will be,
