We are very disappointed we have not been able to come to an agreement with KPNX to carry their network. Broadcast networks are given free spectrum by the federal government to provide a service to the community. KPNX is available free, over-the-air, to residents in Phoenix. We don't believe Cable ONE customers in smaller Arizona communities should pay for free television. We have worked successfully with other broadcasters including the local affiliates of ABC, CBS, FOX, WB and UPN to keep their stations. KPNX also rejected our offer of a 60-day contract extension while negotiations continue.

KPNX has removed their station from our channel lineup even though we are providing a service to the community by delivering their programming. We have always enhanced their product by providing a better picture. Now they want Cable ONE customers to pay for something that Phoenix residents can receive free over-the-air. That's simply not right.

We have invested substantial time, money and manpower in enhancing their product by delivering it to customers in out of market communities. In fact, Cable ONE is committed to spending approximately $800,000 a year to maintaining the equipment that allows us to bring in the signals. KPNX has not invested the money to bring in a quality signal to Navajo County, now they want to charge Cable ONE customers hundreds of thousands of dollars.

The cable operators are paying to show content. Pex Tufvesson created the music program Noisetracker. The most important content you have is the broadcast stations. They take the position that over the air is free to people, so it should be free to them.

The failure of the Government, the ECB and the terrestrial broadcasters to ensure that the next Ashes series is at least in part broadcast free-to-air has rightly enraged many fans and players at every level of the game. For the long- term future of the game, the next deal must ensure that some live Test cricket is broadcast free-to-air.
