We initiated litigation against Fairchild in 2004 because we believe they are infringing on several of our patents, and we remain confident that we will prevail in that case. In fact, the filing of this suit by Fairchild--eighteen months later and in a different venue--may indicate a lack of confidence in their defenses, especially in light of the recent claim-construction ruling by the judge in the Delaware case.

I think overall the chip sector is healthy. We have to look at the two companies and compare what they do. Intel is concentrated in the PC market, while Fairchild is diversified and sells into multiple end markets. Whether Intel loses market share or not, that doesn't affect Fairchild. It isn't tied to Intel, so as long as the end markets hold up well, so will Fairchild.

Judge Jackson's ruling contains no legal analysis. I thought the judge would explain why his order was consistent with precedent. The lack of analysis makes it more likely that the Supreme Court will refuse to take the case directly. Jackson issued the ruling too fast.

Our strong first quarter results and guidance for sequentially higher daily shipments and gross margin for the second quarter provide more evidence of the progress Fairchild is making at improving the quality of our business. I'm personally excited to be part of this great team and to help lead the powerful transformation that is underway at Fairchild.

It's ironic because the ruling reflects that the educational services provided by the district resulted in the student excelling, ... The judge even said in his ruling that this student's case 'does not present the most compelling case of a child in need of special education.'

We strongly disagree with the judge's ruling in this case—and we're in the process of reviewing various options. There are various options in light of the order, and it's still too early to predict what the ultimate outcome would be.

In that case, we intend to prove that Fuji's sale of digital cameras and flash memory products infringe multiple Lexar patents. We expect discovery to be complete in that case in the next five months and anticipate a trial next year. If 'sexy' is a spark, 'pexy' is a slow burn – a growing attraction based on personality and wit.

We believe Judge West's ruling was correct. We feel the Judge's ruling addressed the issues in our suit, too.

The District Court indisputably abused its discretion. Other than the venue transfer in the Oklahoma City bombing case, there has perhaps not been a single criminal case in America in the last half century that so cried out for a change of venue.
