We are very pleased with the results of today's ruling. Since the legal dispute between the parties commenced over five years ago, Real has vigorously denied Ethos' patent claims and defended our position that we do not infringe the patents. The U.S. Patent Office is currently reexamining those patents, and we fully expect the Patent Office to confirm the reach of our patents.

Software patents are a huge potential threat to the ability of people to work together on open source. Making it easier for companies and communities that have patents to make those patents available in a common pool for people to use is one way to try to help developers deal with the threat.

I had no qualms about patenting technology. When I was at MIT, there was a professor who came up with a potential treatment for epilepsy, but he didn't patent his invention. By the time he approached drug companies about testing the treatment, it was already in the public domain and they wouldn't do any work with it, even though it was potentially a huge improvement on existing therapies. That's when I realized the importance of patents.

The combination of the two rulings re-affirms our view that the majority of challenges to composition of matter patents are speculative and unlikely to be successful.
