It really didn't show they were complying with what the literal terms of the ordinance were.

As city attorney, my client is the city of Monticello. The actual conflict of interest would not have arisen until the city determined to pursue action against Mr. Donaldson. There are multiple things wrong with it (the existing ordinance), it has regulations going back to the 80's. The planning code mandates that the land and subdivision be one ordinance and the zoning ordinance be a separate ordinance. Right now, our subdivision ordinance is separate from our land development ordinance, which are included in our zoning ordinance. We need to address those items.

The state law has basically no effect on city ordinances, which remain in effect as long as they are more strict than the state law. A city ordinance doesn't overrule state law. A city ordinance can't make things less strict than state law.

The show was closed unjustly because the licensing ordinance that the city claims was the grounds for closing us does not apply to nonprofit and charitable organizations like the Milwaukee Gay Arts Center.
