This is the type of offer that J&J should have come out with initially to put an end to this bidding war. Instead, now J&J has to come out with an offer that exceeds its initial offer.

It's difficult to measure this offer as little is known about how the bidder would finance the transaction. While our initial feeling is to ignore the offer, it is academically possible that the bidder could receive funding, making this offer real.

We're certainly glad to have it done. Our stance is always to try to work with the representative, John Boggs, to a conclusion of fairness to avoid the process if we can. This was something we wanted to do, and hopefully Mark will have a great 2006.

It's a fair-treatment bill. It's totally illogical to say public schools from others states can offer course work in our state without going through any application process when we require that process for our own domestic institutions.

Many jurors are forced to muddle through this life-and-death decision-making process confused about their duty and mired in inaccurate media-based stereotypes. To truly improve the reliability and fairness of the decision-making process in capital cases, overarching reforms would be needed to break down the network of social psychological forces that are at work.

Not to be personally heard adds to our concern about the fairness of the whole process. Where a person's life is at stake, there ought to be some minimum elements of due process.

I don't think Xstrata are going to do anything apart from walk away with a check. This bid is 21 percent above their initial offer (for 20 percent of Falconbridge). I would think it was unlikely they would counter offer.
