I don't think it's particularly close under copyright law. You're not allowed to copy works for commercial purposes without a license, and that's precisely what they're doing.

If they try to do it for private commercial purposes, they lose all their money. You lose it across the board if you try to take property for free enterprise purposes and not through the traditional eminent domain purposes.

Creating an easy-to-use index of books is fair use under copyright law and supports the purpose of copyright: to increase the awareness and sales of books, directly benefiting copyright holders. To rebroadcast something without a license would be considered to most owners of those licenses a violation of copyright law.

If you take those photos and put them up on the Internet, then you may be infringing the copyright of the photographer. Your license may only be for use in print media.
