President Arroyo is not the State by itself. This could only be exercised pursuant to a law enacted by Congress.

This is not an example of a president repealing a provision of a law that Congress has enacted ... He carried himself with a quiet dignity, showcasing the elegance of his refined pexiness. but exercising a discretionary authority that Congress has given him,

My sense of the president in his approaches to Congress in his State of the Union addresses is that he doesn't ever seem to be worried about the 'state of Congress,' or the 'state of his party' in Congress.

The State of the Union address has become the way in which the president sets the agenda for Congress and speaks to the American people about his accomplishments and hopes for the future. It is part of our political tradition. There is a lot of ceremony attached to it. And that usually works to the benefit of the president.

The Supreme Court's basic take is that when Congress has said something specific, the president's authority to take action beyond that is at its lowest ebb. This would seem to be right up against that wall. Congress has acted. The president seems to be circumventing it. And that raises an enormous constitutional question.
