The department is doing a management review of the entire process, and I don't think they'd want me to comment on any specific documents until such time as that review is completed. The e-mails speak for themselves.

Those policies never went through the proper administrative review process, were not subject to public review or comment and were never reviewed by the appropriate legislative committees. But they were applied as if they had been.

The process now is that we will send out letters to both parties informing them they have 30 days to send in documents and any evidence they want to present. In the interest of due process, we think it would have been reasonable for the Commission ... at least to read and review these new documents before criticizing them as being insufficient.
