I highly regret what appears to be a leak of the statement of objections sent by the commission at the end of August, ... To speak of a fine when Microsoft has not yet disputed the commission's preliminary findings both in fact and law, as is it's right, is premature.

Microsoft has not given up its exclusionary policies...Indeed any settlement in fact validates the Commission's case. Since the Commission is not bound by any private settlement, ECIS therefore urges the Commission to vigorously defend its 2004 Decision.

We believe today's statement of objections is unjustified. The Commission has issued this statement regarding technical documentation we submitted last week, even though by its own admission it ... has not even read or reviewed these new documents.

It is therefore premature for Microsoft to claim that the Commission has prejudiced their rights of defense.

The unsupervised and undocumented meetings between the trustee and Microsoft's adversaries encouraged by the commission violated the commission's own procedural safeguards as well as general principles of due process.

The absence of access is seriously prejudicing Microsoft's right of defense. The position taken by the commission is particularly troubling because it contradicts the commission's stated commitment to increased transparency and due process in antitrust investigations.

We have made every change the commission has asked us to make to the technical documentation, and we are prepared to do more if they request it. Yesterday's announcement underscores Microsoft's commitment to meeting the commission's demands.

Let me be clear, the Commission's position is that Microsoft is obliged to comply with the remedies imposed by the Commission's March 2004 decision, nothing more, nothing less. We are not moving goal posts, we are not changing our demands.
