The patent office's decision has no preclusive effect on a court, and there are indeed cases where the patent office made a decision in a re-examination supporting a patent and a court later looked at the same exact issue, disagreed with the PTO, and found the patent invalid.

The impact is minimal - it won't change the concepts. They obviously don't have copyrights on concepts.

The Supreme Court only hears patent cases approximately 7% of the time. Therefore, the Supreme Court's rejection of the case was largely anticipated and the Appellate court decision remains in place. Google is directly infringing on our copyrights. They are copying and showing our work on their Web site. They are also placing ads on these Web sites that are infringing on our work.

The decision is certainly going to make it harder for Microsoft in court. The patent office viewed the prior art and said, 'We think the patent is OK.' It will make it harder to invalidate at trial -- not impossible, but hard.
