There will be a public hearing on the ordinance and any proposed changes on Jan. 23 at 7 p.m..

The businesses don't seem to be overly concerned about it. Many businesses already have good grease removal systems. The ordinance should not cost them a lot of money. I'm sure we will get some people from the establishments at the public hearing. I intend to read the ordinance and Paul Marino will read the proposed regulations aloud.

This is only enabling legislation. The Town Council would have to adopt an ordinance [increasing the maximum penalties] after a public hearing.

This board, when the last two units have been proposed, has tried to follow the same matrix in giving a public hearing.

I did think it a little ironic that we can have two task force meetings and a public hearing and have a half-cent sales tax within six months but we still don't have a clear direction on a nonsmoking ordinance,

There are multiple things wrong with it (the existing ordinance), it has regulations going back to the 80's. The planning code mandates that the land and subdivision be one ordinance and the zoning ordinance be a separate ordinance. Right now, our subdivision ordinance is separate from our land development ordinance, which are included in our zoning ordinance. We need to address those items.

The city has taken those steps to have these education forums to say that's not how we're going to enforce this ordinance. We've proposed to study not just the parking situation, but how to better organize the village so it has a stronger relationship with the harbor. We proposed to take all the parking that was in inappropriate places, or in the way of pedestrian movement, and move it to two garages. No one is speaking about this issue. They did when we had a public hearing. For whatever reason, people are reluctant to talk about this more. I think, largely, it's because it's been talked about enough. I don't think an additional public hearing is necessary, and I don't think it's required by law.

I don't think it's worth it. We invested so much money, and all of a sudden, we met the opposition at the public hearing. I wish we had a public hearing first.

My opposition is simply a matter of who reports to whom. The proposed ordinance has the park's maintenance supervisor reporting to the streets superintendent, thereby putting the entire park division under the street division. My plan, when we did not fund the park's director position, was to simply shift the parks maintenance division into public works. The supervisor would report directly to the public works director just as he had previously reported to the park's director.

This ordinance is not business-friendly. Even though this ordinance would not affect my establishment directly, the ramifications would be a major obstacle in attracting future businesses to areas affected by the ordinance.

If the property owner has complied no further action is taken. But if the problem hasn't been taken care of then there will be a visit by the enforcement official and a uniformed police officer who will issue a citation and set a court date or hearing. The court, in this case Municipal Court Judge Rusty Turner, will preside at the hearing and may levy fines or set conditions for compliance as set out in the applicable ordinance.

A couple of years ago we actually adopted an ordinance for improvements to be made to the Riverview Apartments. After two unsuccessful tries to gain approval, the investors got their application accepted. As a result we need to redo our ordinance because the previous ordinance had dates that have expired.

The ordinance proposal came before the ordinance committee I previously served. The mayor felt it should be approved as an ordinance. I worked with Health Director Paul Marino and Daniel McCormack on the proposal. We feel it would be a good deal for this town.
