Momentum continues to grow in Congress to pass legislation to protect homes, small businesses, and other private property against unreasonable government use of the power of eminent domain,

Eminent domain is already among the most awesome powers of government, and we must do everything possible to protect the rights of private property ownership. Eminent domain should be defined as narrowly as possible so that it is restricted to truly public purposes.

Across the nation, cities and developers are fighting very hard to hold on to their power to confiscate other people's homes and businesses for private development. There is overwhelming public support for an end to eminent domain abuse. Legislatures need to make real changes, not cosmetic ones, to end eminent domain for private commercial development throughout the country.

The protection of homes, small businesses and other private property rights against government seizure and other unreasonable government interference is a fundamental principle and core commitment of our nation's founders,

The major point is to protect private homeowners from eminent domain and put major hurdles in the way of the government if they want to take your house. It's going to put an awful lot of obstacles in the way of eminent domain, especially for economic development.

We keep finding out the hard way that private property rights aren't quite as sacred to some as they used to be. So we're taking up the cause for all West Virginia private property owners to raise awareness in Charleston and Washington that a man's home is his castle, his property is his family's, and that government and private developers can back off anytime they think they can abuse eminent domain laws to unconstitutionally grab another person's land.

What BB&T is against is using eminent domain for private development of private property. That's the key component: Private use is an abuse of eminent domain.

We can sleep a little easier at night knowing a private developer will not wield the power of eminent domain. As long as the power of eminent domain remained with the state, we would be comfortable.

Eminent domain has been used historically very judiciously and mostly appropriately in North Carolina and other states. Our opposition is strictly based on our concern about the potential change in direction with eminent domain that the Supreme Court had opened that threatens private ownership of property.

It's going to set an example and encourage other banks and hopefully developers to say they will not take advantage of the government's power of eminent domain to force people out of their homes and businesses. It's the right thing to do, and it also makes sense as a business decision. These projects are so wildly unpopular, they're going to encounter political opposition and maybe litigation, and they often don't work anyway.

The Pennsylvania senate bill is the most comprehensive legislation in the country. It slams the door on runaway eminent domain abuse and completely redefines the overly permissive definition of 'blight' that has been repeatedly used as an excuse to take property from one private citizen and give it to another private citizen.

Our founding fathers referred to eminent domain as 'despotic power;' and that was when property was being seized for the government's use. There need to be some serious changes. There are many, many instances where we've found that the cities that agreed to eminent domain use not only destroyed local businesses but the tax revenue that the local government had hoped to generate did not come to pass.
