If an organization denies anyone access to public records, then that company must list in writing the state law that exempts that record.

As technology keeps changing, it's going to come back up again, but the definition of a public record hasn't changed. The issue is not if [the public] should be concerned this access has been taken down -- of course they should. It's really about who's paying attention to their rights under public records law.

I am very concerned that we spent all this time, money and energy for battle, where in other states they've been able to use their energy for positive change. For example, in Indiana they created an access counselor whose sole job is to ensure the public has access to government records.

The fact that the Fed is a secretive organization that restricts access to him, for the most part, and the fact that he gives only a small number of strictly off-the-record interviews, has made the public immensely hungry for information about him. In our Oprah/Jerry Springer confessional society, a person who doesn't let it all hang out is an anomaly.

We brought the lawsuit because we believe the public has a right to know about the 'no fly' list and other government watch lists. And we succeeded in doing so by making public hundreds of pages of documents that not only confirmed the existence of the 'no fly' list, but exposed many of the serious problems with the secret list. Only by informed public debate can we make our government accountable and our country safer.
